1. Delivery
Orders and deliveries are generally possible worldwide. Sales are made exclusively to private end consumers. Items are only sold in household quantities.
2. Validity of Prices
The prices listed on www.mooloolabas.com include the statutory value-added tax and the applicable currency is EURO.
3. Shipping Costs
We deliver according to the latest version of the shipping cost table.
Cash on delivery shipments are not possible.
4. Payment and Credit Check
You can choose to pay in advance, via PayPal, or by credit card. In individual cases, Blue n´Red reserves the right to exclude certain payment methods. Unfortunately, we cannot accept cash or checks. In case of loss, we exclude liability unless there is gross negligence or intent on our part.
If we provide services in advance, e.g., in the case of purchase on account, we may obtain a credit report based on mathematical-statistical methods from the companies listed below to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to these companies and use the information received about the statistical probability of a payment default for a balanced decision regarding the establishment, execution, or termination of the contractual relationship. The credit report may include probability values (score values) calculated based on scientifically recognized mathematical-statistical methods, which include address data in their calculation. Your legitimate interests are taken into account in accordance with legal provisions.

5. Retention of Title
The goods remain the property of Blue n´Red until full payment has been made.
6. Warranty
We are liable for material and legal defects of the delivered items according to the applicable statutory provisions, in particular §§ 434 et seq. BGB. For all defects occurring during the statutory warranty period, you may assert your legal claims for repair or replacement at your discretion. If the legal requirements are met, you may also assert claims for a reduction in the purchase price or damages or withdraw from the purchase contract.
If we grant you a seller's guarantee, the details are set out in the warranty conditions, which are attached to the delivered item. Warranty claims do not affect your statutory claims and rights.
7. Liability
Subject to clause 7 and the provisions of the Product Liability Act, we are not liable for damages. Exceptions are claims for damages by the customer arising from injury to life, body, health, or from the breach of essential contractual obligations (cardinal obligations), as well as liability for other damages based on intentional or grossly negligent breach of duty by us, including our legal representatives and vicarious agents.

All image and trademark rights belong to Blue n´Red or its partners. Use without express consent is not permitted.
10. Data Protection
Your personal data will be treated confidentially by us. Storage takes place within the scope of business processing. If necessary, data is passed on to companies involved in business processing. Apart from this, data is not passed on to third parties, subject to clause 4.
11. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an non-binding online catalog. By clicking the "Submit Order" button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order follows immediately after sending the order and does not yet constitute acceptance of the contract. We can accept your order by sending an order confirmation via e-mail or by delivering the goods within five days.
